General Terms and Conditions (T&Cs) of Participation in the "Meet with Ibexa" Competition

(As of March 2024)

1. General Terms and Conditions of Participation 

The “Meet with Ibexa” Competition (herein referred to as the “Competition”) is organized by Ibexa GmbH with registered address at Kaiser-Wilhelm-Ring 30-32, 50672 Cologne, Germany (herein referred to as “Ibexa”)  

By participating in this Competition, all participants expressly agree to be bound by the T & Cs. Ibexa’s decision regarding any matter relating to the Competition shall be final and binding on the participants.  

Participation in the Competition is free of charge. 

2. Timeline 

The Competition starts on the 11th of March 2024 at 12:00 (CET) and ends on 28th March 2024 at 12:00 (CET) (herein referred to as “Promotion Period").  

Entries made before or after the Promotion Period will not be considered for the Competition.  

3. Eligibility 

The Competition is open to persons who meet the following requirements:  

  • Participants must be a natural person residing in Germany/Austria/Switzerland  
  • Participant must be 18 years or older. 
  • Participant must fill out and submit the form on the https://www.ibexa.co/events/omr24 page within the Promotion Period. 
  • Participants may only enter in their own name and/or email address. It is strictly forbidden for the same participant to enter the Competition with several names and/or email addresses, or to enter the Competition from an account opened for the benefit of another person. 

4. Who cannot participate? 

Company officers and employees of Ibexa including their spouses, children or direct members, close relatives or any other person that may benefit or be in a position to interfere with the outcome of the Competition, will not qualify to participate in the Competition and will not be eligible for any prize.   

Legal entities/Companies are not eligible to participate in the Competition.  

5. Prize 

Regardless of the number of entrants, the Competition will have three winners. 

Three (3) participants stand the chance to win an OMR Festival ticket worth 499.00 euros. 

6. Rules of the Prize 

The prize draw selection will be held after the Promotion Period on the 28th March 2024.

The draw is carried out by Ibexa. Winner is selected based on an automatic random selection from the pool of qualifying participants. 

A cash payment, change or exchange of the prize is not possible. 

Rights to prizes may not be transferred or assigned to other persons. 

Participation in the Competition does not oblige you to enter into contracts with Ibexa. Also, the conclusion of contracts with Ibexa does not affect the possibility of winning. 

Ibexa reserves the right to disqualify any participant, withdraw or withhold any prize if there are reasonable grounds to believe that the participant has breached the provisions of these T & Cs.  

Prize decisions made by Ibexa shall be final, non-negotiable, and non-challengeable.

To the fullest extent permitted by law, the winners agree that their names and/or photograph may be published or announced in any media publication for publicity and advertising purposes and such usage will not grant the winners any further compensation.   

7. Notification and Forfeiture   

On the conclusion of the draw selection and announcement of winner, the selected winner will be notified immediately via LinkedIn and/or email of the procedure to follow to claim the prizes.     

The winner must accept the prize in writing with his real name and address details within three (3) calendar days from the date the notification was sent. 

Prize not accepted within the afore-mentioned period are deemed forfeited by the winner, and another participant will then be drawn as winner.  

Ibexa will deliver the prize to the winner by e-mail to the address provided by the winner.

8. Disqualification of winners and/or participants   

Ibexa may withdraw, withhold prizes at its sole discretion or disqualify participants at any stage of the competition for the following reasons:   

The participant has deviated from the rules of the Competition and has attempted to manipulate the outcome in order to be entitled to participate in the Competition or win a prize.  

Ibexa finds it practically impossible to establish a line of communication with the prize winner.   

The selected winner lacks legal capacity under applicable laws or falls under the category of participants prohibited under Clause 4 from participating in the Competition.   

Failure to comply with the T & Cs.  

It would be unlawful under the applicable local laws and regulations to award the prize to the winner.   

9. Cancellation of the Competition 

Ibexa reserves the right to interrupt, modify or completely cancel the Competition at any time for good cause without prior notice. Important reasons exist in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, a proper execution of the competition cannot be guaranteed. 

If such a case is caused by the conduct of a participant, Ibexa may demand compensation from this person for the damage incurred. 

10. Limitation of Liability  

To the fullest extent permitted by law, by participating in the Competition, the  participant agrees to indemnifies Ibexa, its holding, affiliates and/or subsidiaries, its officers, agents, employees, successors  and assigns from and against any loss, damages, actions, claims, expenses and any  other liabilities of any nature suffered or sustained by Ibexa as a result of any third party claims arising from the participant’s participation in the Competition, violation of these T & Cs, and/or acceptance, receipt, ¨use and/or misuse of the prize.   

As Ibexa is not the manufacturer of the prize neither the supplier of the service that this prize could represent, it cannot be held responsible for any prejudice whatsoever (personal, physical, material, financial or other) arising from the use of the prize. 

The winner agrees not to resell the prize and is solely responsible for the choice and use of the prize. 

To the extent permitted by law, Ibexa will not be liable in any way whatsoever, for any claims arising from loss, injury, damage, or costs, suffered by participants in relation to the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information provided to the winner.  Ibexa shall only be liable for damages caused by willful misconduct or through gross negligence by Ibexa, its legal representatives or vicarious agents.  

By accepting these T & Cs and participating in the Competition, the participant undertakes that such decision is done of his free will and volition and such participant shall be legally responsible and liable for any loss, damage or legal expenses suffered by the participant because he/she took part in the Competition.  

11. Data protection 

Personal data of all participants and winner(s) will only be processed to the extent and for as long as this is necessary for the implementation of the Competition and the processing of the prize, and in accordance with the EU General Data Protection Regulation, unless consent has been given to receive Ibexa newsletter. Personal data such as surname, first name and e-mail address will be treated by Ibexa in accordance with legal provisions. 

Personal data collected by Ibexa in the context of the Competition, such as the surname, first name and e-mail address of participants, will be processed by Ibexa in accordance with legal provisions.

12. Notices 

The Parties hereby acknowledge that any communications under this agreement shall be in writing. Notices and correspondences between the parties may be sent by fax, email or by registered mail/courier to the receiving party. Such notices or correspondences shall be deemed to have been received three (3) days after dispatch, in the case of registered mail/courier by handing the said correspondence to a reputable courier service for immediate delivery to the addressee in a properly addressed package.           

13. Invalid provision 

If any one or more of the provisions in this Agreement are deemed invalid, illegal, void, or unenforceable in any respect by law or a competent court, the validity, legality, and enforceability of the remaining provisions of these Terms and Conditions shall not in any way be prejudiced, affected, or impaired 

14. Governing Law and Jurisdiction  

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.  

If any dispute arises between the parties, hereto relating to the interpretation and/or application of this scheme, which cannot be resolved by mutual consultation, such dispute shall be referred to the German Court.
